Family Court I: Judge Cheryl Moss says she has a full calendar and can't debate challenger Greta Muirhead. My guess is Moss still doesn't want to answer questions we've long tried to ask about the case of Syber Wells, the 12-year-old who killed himself with his father's rifle. Moss dismissed concerns from Syber's mother about the guns in her estranged husband's home, with tragic results.

Family Court J: Judge Lisa Kent, who earned dismal ratings in a survey of lawyers, says she can't debate challenger Ken Pollock because both of the judge's parents are in the hospital.

Family Court K: Vincent Ochoa and Cynthia Giuliani meet again on October 8 in a program that will air on October 10.

Family Court L: Judge Jennifer Elliot takes on challenger Dawn Throne on October 17.

Family Court N: Two family court attorneys making another bid for the bench, Gayle Nathan and Matthew Harter, go Face to Face October 9.

Candidate Landess named in Securities & Exchange Commission complaint

"On July 29, 2008, the United States Securities and Exchange Commission filed a civil injunctive action in United States District Court for the Southern District of Texas, Houston Division, alleging that six individuals, including a Houston, Texas attorney and a Las Vegas, Nevada attorney, violated various provisions of the federal securities laws in their unregistered, nonexempt distribution of more than 10.8 million shares of the common stock of a Houston, Texas software development company. The complaint further alleges that the six individuals, and one relief defendant, collectively reaped proceeds exceeding $3.91 million from their illegal scheme.

Named in the Commission's complaint are:

Robert L. Sonfield, 76, a Houston, Texas, attorney;
Donald C. Bradley, 76, of Las Vegas, Nevada;
Jeffrey W. Bradley, 48, of Las Vegas, Nevada;
Jason Landess, 62, a Las Vegas, Nevada, attorney;
Marc Lane, 46, believed to reside in Cadiz, Spain;
Roger Brewer, 52, believed to reside in Penzance, England; and,
Alexanderia Blankenship, 46, of Houston, Texas (named as a relief defendant only, for purposes of securing a return of stock sales proceeds transferred to her)."

I'm surprised that this story did not surface prior to the primary election. It should be an interesting factor in the general election between Landess and Stefany Miley for Department 23.

Primary Election Results

The Secretary of State has finally updated its website with results from 100% of the precincts. The website lists erroneous percentages for the Supreme Court races, as it did all night yesterday. Generally, the Secretary of State's election return page is a huge disappointment. I'm hoping it gets improved by the time of the general election.

Standing Committee on Judicial Ethics and Election Practices Issues Opinion

The Standing Committee on Judicial Ethics and Election Practices issued a decision yesterday, Published Decision 08-2, in which it concludes that Family Court Maria Maskall violated Committee Rule 4.5 by releasing opponent Brigid Duffy's unpublished response to the Committee to the public.

Both Maskall and Duffy lost in the primary election.

The Nevada Secretary of State has not yet posted reports by candidates for Supreme Court Seat B. I will post these as soon as they are available.

And now for a vent: the deadlines for these reports needs to be moved up by two weeks. Early voting for the primary began over a week ago and this information may be useful to voters -- presumably that is the reason the reports are generated. Someone needs to fix this.

More election matters filed with the Nevada Supreme Court

It's pretty tough to keep track of all of the writs and appeals pending before the Nevada Supreme Court concerning the 2008 election. Most of them are listed on the Court's High Profile Cases page and links are provided to the documents filed in those proceedings.

New filings include a challenge by Family Court candidate Maria Maskall to the candidacy of her opponent Brigid Duffy. Maskall contends that Duffy is not qualified to be a candidate for district court judge because she will not have been a licensed and admitted attorney for 10 years prior to the election (as opposed to the date that she was take office if elected).

There is also a challenge to the candidacy of Senator William Raggio based upon term limits.

Candidate filings complete

The filing deadline for judicial candidates was in January, but most other candidates facing election this year filed this week.

The Secretary of State has a list of candidates for national, statewide and rural races, with photos!

Clark County's list is available and includes information on local races and Congressional Districts 1 and 3.

Washoe County's list is available here.

There are some interesting races. Sharron Angle filed against Bill Raggio. Steve Sisolak and Brian Scroggins filed against Bruce Woodbury (who has received conflicting opinions from the Secretary of State and DA's office as to whether he is eligible due to term limits).

Daskas drops out of congressional race

Former Clark County prosecutor Robert Daskas has announced that he is dropping out of the 3rd District race against Jon Porter. Jon Ralston provides the text of Daskas's press release:

"Citing family considerations, Robert Daskas has announced his decision to withdraw his candidacy for Nevada's Third Congressional District. The Daskas campaign has every confidence that another strong, viable candidate will enter the race and unseat incumbent Jon Porter. Daskas thanks everyone for their support and asks supporters to stay focused on the common goal of changing our representative in the Third Congressional District. Democrats now hold a 22,500 voter registration advantage over Republicans in the district."

No word yet as to whether or not Daskas will resume his career with the Clark County District Attorney's Office.

Las Vegas Sun examines Judge Mosley's campaign expenses

The Las Vegas Sun reports that District Court Judge Donald Mosley will not recuse himself from presiding over former Clark County Commission Lynette Bogg's criminal case, even though similar accusations have been leveled against him. Boggs has been indicted on charges that she illegally spent $1,200 in campaign money to employ a nanny. She states that the nanny was employed while she was attending campaign events. Mosley received scrutiny after providing $10,000 to his former girlfriend. According to the Sun, the girlfriend claimed that the money was a gift while Judge Mosley asserted that the money was a brief loan to the woman.

2 candidates leave races

January 31st was the final deadline for judicial election candidates to withdraw their notices of candidacy. Two candidates in Clark County pulled out: Michael Root, who was challenging Judge Herndon, and Mark Karris, who was opposing Eric Goodman for Justice Court Department 11. With those changes, the following list reflects judicial elections for 2008.

Chairez and Schumacher file for Supreme Court

The Las Vegas Review Journal reports that former district court judge Don Chairez and current Washoe County district court judge Deborah Schumacher have filed notices of candidacy for the Nevada Supreme Court seat currently occupied by Justice Maupin. Justice Maupin will not seek re-election

Justice William Maupin has announced that he will not seek a third-term as a Nevada Supreme Court Justice.

I remember when Justice Maupin was first elected to the Court and recall feeling less than thrilled about him being in that position. I was wrong. Very, very wrong. Justice Maupin has been the source of many thoughtful and scholarly opinions and has made a very positive contribution to criminal law jurisprudence in this state. I am sorry to see him leave.
