In Ouanbengboune v. State, a three justice panel (Chief Justice Hardesty and Justices Parraguirre and Douglas), finds that an inaccurate translation made during trial by a court-appointed interpreter did not warrant the grant of a new trial upon finding that the defendant was not prejudiced by the inaccuracies. The Court sets forth the procedures for addressing this type of issue when the erroneous translation is discovered post-trial.   The Court also finds that the trial court did not commit plain error in failing to instruct the jury on afterthought robbery.
